1. General Provisions
1.1. This Privacy Policy (hereinafter — the "Policy") defines the procedure for collecting, processing, storing, and protecting the personal data of guests of CITY STAY Apart-Hotel Almaty (hereinafter — the "Operator").
1.2. The Policy has been developed in accordance with the Law of the Republic of Kazakhstan "On Personal Data and Their Protection".
2. Consent to Personal Data Processing
2.1. Check-in at CITY STAY Apart-Hotel Almaty, completion of a booking, as well as the provision of identification documents constitutes the guest's unconditional, informed, and voluntary consent to the collection, processing, and storage of their personal data.
2.2. Such consent is provided in accordance with the legislation of the Republic of Kazakhstan and does not require additional signing.
2.3. If the guest refuses to provide personal data or refuses to consent to its processing, the Operator has the right to refuse check-in and service.
3. Personal Data Being Processed
3.1. The Operator processes the following personal data:
— full name,
— individual identification number (IIN),
— identity card or passport details,
— contact phone number,
— email address,
— booking and stay information,
— payment data (to the extent necessary for settlements),
— photo and video images of the personal data subject captured by surveillance cameras on the apart-hotel premises.
4. Purposes of Personal Data Processing
4.1. Personal data is used for:
— registration and check-in of guests,
— performance of the hotel services agreement,
— compliance with the legislation of the Republic of Kazakhstan,
— bookkeeping and tax accounting,
— communication with guests,
— improving service quality,
— ensuring the safety of guests, employees, and the Operator's property (including the use of video surveillance systems).
5. Legal Basis for Processing
5.1. Processing of personal data is carried out on the basis of:
— the necessity to perform the offer agreement,
— the requirements of the legislation of the Republic of Kazakhstan.
6. Transfer of Personal Data to Third Parties
6.1. The Operator may transfer personal data to:
— state authorities in cases provided for by law on the basis of an official letter and/or act,
— payment systems and banks,
— booking and management systems,
— specialized software solutions for hotel management, including the property management system (PMS) "Shelter",
— other contractors necessary for providing services.
6.2. The transfer is carried out in compliance with the requirements of the legislation of the Republic of Kazakhstan.
7. Storage of Personal Data
7.1. Personal data is stored no longer than is necessary to achieve the purposes of its processing.
7.2. Storage is carried out in compliance with the requirements of the legislation of the Republic of Kazakhstan, including requirements for the localization of personal data.
7.3. Video surveillance data from cameras in the public areas of the apart-hotel premises is stored for a limited period, unless otherwise required for the investigation of incidents or compliance with the requirements of the legislation, subject to an official letter and/or act.
8. Personal Data Protection
8.1. The Operator takes the necessary organizational and technical measures to protect personal data.
9. Rights of the Personal Data Subject
9.1. The guest has the right to:
— receive information about their personal data,
— request its clarification or modification.
9.2. Withdrawal of consent is carried out by written request to the Operator.
10. Destruction of Personal Data
10.1. Personal data is subject to destruction:
— upon achievement of the purposes of processing,
— upon withdrawal of consent (if there are no other legal grounds for storage),
— in other cases provided for by law.
11. Use of Cookies
11.1. The CITY STAY Apart-Hotel Almaty website may use cookies and similar technologies to ensure the correct operation of the site, analyze user behavior, and improve the quality of service.
11.2. Cookies are not used to identify the user without their consent and are not transferred to third parties, except in cases provided for by law.
11.3. The user has the right to disable the use of cookies in their browser settings, however this may affect the correct operation of the site.
12. Video Surveillance
12.1. Video surveillance is conducted on the premises of CITY STAY Apart-Hotel Almaty to ensure the safety of guests, employees, and property.
12.2. Video surveillance cameras are located in public areas (reception, corridors, entrance areas, and other common-use areas) and are not installed in rooms or other areas where privacy must be observed.
12.3. The fact of being on the apart-hotel premises constitutes the personal data subject's consent to video surveillance.
13. Final Provisions
13.1. The Operator has the right to make changes to this Policy.
13.2. The current version of the Policy is available:
— on the apart-hotel website,
— or provided upon request.
